End User License Agreement

PLEASE READ THIS END USER LICENSE AGREEMENT (“EULA”) CAREFULLY BEFORE USING AELION CLOUD SYSTEM. By installing or using the software, you agree to be bound by these terms.
Agreement
This EULA is a legal agreement between you (“User”) and Infinite Aether GmbH(“Licensor”) for the use of Aelion Cloud System(“Software”). By installing, copying, or using the Software, you agree to be bound by the terms of this EULA.
License Grant
Subject to the terms of this EULA, Licensor grants you a limited, non-exclusive, non-transferable license to install and use the Software on servers you control, within the limits of your purchased license tier.
License Types
The Software is licensed based on usage limits:
2 nodes, unlimited servers, community support
Unlimited nodes, auto-scaling, priority support, white-labeling
Exceeding your license limits requires upgrading to an appropriate tier.
Restrictions
You may NOT:
Ownership
The Software is licensed, not sold. Infinite Aether GmbH retains all right, title, and interest in and to the Software, including all intellectual property rights.
Updates
Licensor may provide updates, patches, or new versions of the Software. This EULA applies to all updates unless a separate agreement is provided.
Support
Support is provided according to your license tier. Free tier users receive community support only. Paid tiers receive email support as specified.
Warranty Disclaimer
THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
Termination
This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must uninstall the Software and cease all use.
Governing Law
This EULA is governed by the laws of Germany. The exclusive place of jurisdiction for all disputes arising from this EULA is Berlin, Germany, to the extent permitted by applicable law.
By using Aelion Cloud, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms.
